The Guarantee Court of Calama left this Friday subject to the precautionary measure of preventive prison of the former mayor of the commune Daniel Agusto Pérez (former Renovación Nacional), accused by the Public Ministry as the author of the completed crimes of tax fraud and incompatible negotiation.
At the formalization hearing, the judge Juan Pablo Gómez ordered the entry of Agusto Pérez to the Calama Preventive Detention Centerconsidering that the freedom of the accused constitutes a danger to the security of society.
According to the Prosecutor’s Office, between 2017 and 2018the accused as mayor of Calama and president of the Municipal Corporation for Social Development (Comdes)became aware of the purchase, by the aforementioned organization, of a property owned by a hereditary succession in which a cousin and maternal aunt appear, for the sum of 190 million pesos with funds destined for primary health benefits.
Although the acquisition was objected by the Comptroller’s Office, as it did not comply with what the law establishes, The communal chief did not prevent the contract from being finalized.
«The mayor would have neglected a series of legal obligations; among these, exercising permanent hierarchical control of the functions of his units and the actions of his officials, as well as other official obligations of the Administrative Statute for municipal officials, which establish, in general terms , that mayors must strictly observe the principle of probity,» said the regional prosecutor of AntofagastaJuan Castro Bekios.
The court set the investigation period at 90 days.
